2. I do not concur in which appears to have been taken by the Administrator and the Law: Councillor that Ordinance no. 8 of 1867 was intended to confer on Government an absolute right of re-entry upon the old Mahomedan cemetery, for all purposes.
And I would point out that in the despatch of 26 June 1867, transmitting that Ordinance, Sir R. Macdonnell only contemplated the possibility of it being distinctly admitted, that it may be resumed by Government for general purposes with the consent of the Mahomedan population "after the lapse of a few years."
3. As therefore the Mahomedans have expressed strong opposition to the proposed use of this ground for building purposes, by which, as appears from the report of the Acting Surveyor General, still contains many tombs from which the remains have not been removed, I am of opinion that their objection should be considered.
